The Department of Public Prosecutions has applied to obtain a work permit for Nicholas J Saunders, to prosecute the Crown’s case against Magistrate Khamisi Tokunbo.
The Magistrates’ Court judge was formally charged earlier this year in connection with a road traffic accident for failing to give a breath sample after the crash on South Road in Paget back in January.
Reports circulating suggest the decision was made to bring in a prosecutor to avoid any conflict of interest by having a local prosecutor deal with the case.
Those sources also indicate that a foreign Magistrate may also be brought in to preside over the case.
Mr Saunders is understood to have already provided legal advice on this case.
DPP Larry Mussenden confirmed to TNN that an overseas counsel from the UK will be brought in to deal with the matter.
But when asked if a foreign Magistrate will be brought in to hear the matter, Mr Mussenden referred TNN to the Bermuda Bar Council.
